Abandonment of use of Fictitious Business Name
Change in Filing Requirements effective 1/1/2024
Pursuant to Assembly Bill 878, Chaptered on 6/29/2023 and effective January 1, 2024, the Business and Professions Code Sections 17913, 17919, 17920, 17922, and 17923 will be amended to remove the registered owner/registrant’s residence address from all Fictitious Business Name (FBN) statement filings and replace it with the business mailing address for privacy purposes. This includes all FBN filing types: original, renewals, abandonments, and withdrawal FBN filings, as well as the Proof of Publication. The proper FBN filing form must be used or it will be returned for correction.

Application for Statements of Abandonment of Use of Fictitious Business Name (PDF) are available here or at the Nevada County Recorder's Office. If submitting your form and paying fees at the office, note that we accept cash, checks or credit card with additional fee $2.00.

Once the Applications are complete, print and signed then mail with appropriate fees (See Fee Schedule (PDF)) to:

Process
Three Certified copies will be returned once the Abandonment of use of Fictitious Business Name is filed.
All Abandonment of use of Fictitious Business Name will be required to:
- Publish the Abandonment of use of Fictitious Business Name in a newspaper of general circulation, once a week for four consecutive weeks, with the first publication occurring within 45 days of the filing date.
- Newspapers have cut off dates, so you will want to deliver your Abandonment of use of Fictitious Business Name to the newspaper as soon as possible or call them to verify what their cut off date is. If you do not begin publication within 45 days of the filing date, a new Abandonment of use of Fictitious Business Name must be filed and published.
