Filing a Withdrawal from Partnership

Change in Filing Requirements effective 1/1/2024

Pursuant to Assembly Bill 878, Chaptered on 6/29/2023 and effective 1/1/24, the Business and Professions Code Sections 17913, 17919, 17920, 17922, and 17923 will be amended to remove the registered owner/registrant’s residence address from all Fictitious Business Name (FBN) statement filings and replace it with the business mailing address for privacy purposes. This includes all FBN filing types: original, renewals, abandonments, and withdrawal FBN filings, as well as the Proof of Publication.  The proper FBN filing form must be used or it will be returned for correction.

Process

Three Certified copies will be returned once the Withdrawal from Partnership Operating under Fictitious Business Name is filed. All Withdrawal from Partnership Operating under Fictitious Business Name are required to:

  • Publish the Withdrawal from Partnership Operating under Fictitious Business Name in a newspaper of general circulation, once a week for four consecutive weeks, with the first publication occurring within 45 days of the filing date.
  • Newspapers have cut off dates, so you will want to deliver your Withdrawal from Partnership Operating under Fictitious Business Name to the newspaper as soon as possible or call them to verify what their cutoff date is. If you do not begin publication within 45 days of the filing date, a new Withdrawal from Partnership Operating under Fictitious Business Name must be filed and published.
