NOTICE FROM THE NEVADA COUNTY CLERK-RECORDER/REGISTRAR OF VOTERS OF OFFICES FOR WHICH CANDIDATES ARE TO BE ELECTED AND DATES WITHIN WHICH DECLARATIONS OF CANDIDACY MAY BE FILED. NOTICE OF MUNICIPAL TAX MEASURES TO BE VOTED ON AT THE PRESIDENTIAL PRIMARY ELECTION AND DATES WITHIN WHICH ARGUMENTS AND REBUTTAL ARGUMENTS FOR AND AGAINST THE PROPOSED MEASURE MUST BE FILED WITH THE NEVADA COUNTY CLERK-RECORDER/REGISTRAR OF VOTERS.

NOTICE IS HEREBY GIVEN by Natalie Adona, Nevada County Clerk-Recorder/Registrar of Voters, in accordance with the provisions of the Elections Laws of the State of California, that on Tuesday, March 5, 2024, there will be a Presidential Primary Election.

NOTICE IS FURTHER GIVEN that at the Presidential Primary Election candidates will be elected to:

NOTICE IS FURTHER GIVEN that official Nomination Petitions and Declarations of Candidacy for eligible candidates desiring to file for the above elective offices may be obtained from the Nevada County Elections Office at 950 Maidu Avenue, Suite 210 in Nevada City, CA 95959, Monday through Friday from 8:00 a.m. to 5:00 p.m., excluding holidays, or the Truckee Town Clerk’s Office at 10183 Truckee Airport Road in Truckee, CA 96161, Monday through Thursday from 8:00 a.m. to 12:00 p.m. and 1:00 p.m. to 5:00 p.m., excluding holidays. Candidates for the City of Nevada City must obtain and file their Nomination Petitions and Declarations of Candidacy with the City or and may contact the City office for more information. Candidates for special districts may obtain more information by calling Nevada County Elections at 530-265-1298 or 1-888-395-1298.

NOTICE IS FURTHER GIVEN that candidate filing for County Central Committees opens Tuesday, September 29, 2023, and will close Friday, December 8, 2023, after which time no Declarations of Candidacy may be accepted for filing. 

NOTICE IS FURTHER GIVEN that the period for judicial candidates to file Declarations of Intention opens Monday, October 30, 2023, and will close Thursday, November 8, 2023, after which time no Declarations of Intention may be accepted for filing. If an incumbent does not file their Declaration of Intention on or before November 8, 2023, the period for all non-incumbents to obtain and file Declarations of Intention will be extended to Monday, November 13, 2023 at 5:00 p.m.

NOTICE IS FURTHER GIVEN that the period to file a Declaration of Candidacy opens Monday, November 13, 2023, and will close Friday, December 8, 2023, after which time no Declarations of Candidacy may be accepted for filing. If an incumbent does not file their Declaration of Candidacy on or before December 8, 2023, the period for all non-incumbents to obtain and file Declarations of Candidacy will be extended to Wednesday, December 13, 2023 at 5:00 p.m.

NOTICE IS FURTHER GIVEN that November 1, 2023 is the final deadline for the governing body of a district, city, school, or other political subdivision which seeks to consolidate a local election for candidates and/or measures to provide formal notice to the County Elections Department.

NOTICE IS FURTHER GIVEN that December 8, 2023 is the final deadline for the governing body of a district, city, school, or other political subdivision which seeks to consolidate a local election for candidates and/or measures to submit resolutions of consolidation to the County Elections Department.

NOTICE IS FURTHER GIVEN that at the Presidential Primary Election the following statewide ballot measures will be put to a vote of qualified voters in the state:

PROPOSITION 1 

The Behavioral Health Infrastructure Bond Act of 2023.* (AB 531, Resolution Chapter 789, Statutes of 2023)

The Behavioral Health Services Act.* (SB 326, Resolution Chapter 790, Statutes of 2023) 

*Please note: Portions of AB 531 and SB 326 will appear on the ballot as Proposition 1.

NOTICE IS FURTHER GIVEN that at the Presidential Primary Election the following local ballot measures will be put to a vote of qualified voters in the district:

CITY OF GRASS VALLEY (MEASURE LETTER TBD) 

Shall the measure for general governmental uses such as reducing the risk of catastrophic wildfire and extreme weather by funding additional firefighters, vegetation management, and emergency evacuation planning by adopting a general, 3/8-cent (0.375%) sales tax raising about $3.4 million yearly, with yearly audits and a citizens’ oversight committee, effective for 7 years unless voters end it sooner, be adopted?

CITY OF NEVADA CITY (MEASURE LETTER TBD) 

Exclusively to fund a locally controlled Wildfire Prevention and Mitigation Program that includes the reduction of flammable vegetation throughout Nevada City; the improvement and maintenance of emergency communications/early warning system, evacuation routes, and temporary refuge areas; the implementation of community oriented defensible space practices; and other activities and services; shall the measure adding a 0.5% Nevada City sales tax, providing approximately $900,000 annually over a five year period, monitored by a Citizen’s Oversight Committee, be adopted?

NOTICE IS FURTHER GIVEN that any written arguments for or against the measures to be submitted to the voters must be filed no later than 5:00 P.M. on Friday, December 15, 2023. Arguments must be signed and dated by the author(s) with a Statement of Accuracy per Election Code § 9600. Arguments shall not exceed 300 words.

NOTICE IS FURTHER GIVEN that when the elections official has selected the direct arguments for and against said measures, the elections official shall send copies of the argument in favor of said measures to the author(s) of the argument against and copies of the argument against to the author(s) of the argument in favor. There will be a 10-day public examination period from Saturday, December 16, 2023 to Tuesday, December 26, 2023, during which a qualified voter of the jurisdiction may seek a writ of mandate or an injunction requiring the City Attorney’s Impartial Analysis or the direct arguments be amended or deleted. 

NOTICE IS FURTHER GIVEN that rebuttal arguments shall not exceed 250 words and must be filed with the no later than 5:00 p.m. on Friday, December 22, 2023 with a Statement of Accuracy per Elections Code § 9600. There will be a 10-day public examination period from Saturday, December 23, 2023 to Tuesday, January 2, 2024, during which a qualified voter of the jurisdiction may seek a writ of mandate or an injunction requiring the rebuttal arguments to be amended or deleted.

NOTICE IS FURTHER GIVEN that at the Presidential Primary Election, all Vote Centers will be open from 7:00 a.m. to 8:00 p.m. on Election Day.

NOTICE IS FURTHER GIVEN that appointments to each elective office will be made pursuant to California Elections Code § 10515 in the event there are no nominees or an insufficient number of nominees for such office and a petition for an election is not filed within the time period prescribed by law.

NOTICE IS FURTHER GIVEN that after the Vote Centers close on the date of said election, ballots will be tallied at the Nevada County Elections Office. The voted ballots will be moved from each Vote Center to be stored at the Nevada County Elections Office.

NOTICE IS FURTHER GIVEN that per Elections Code § 15104, the Registrar of Voters also hereby notifies all interested organizations that the verifying of signatures on Vote-By-Mail ballots cast for the Presidential Primary Election will commence on February 5, 2024 or at any time thereafter in the County Elections Office. On February 5, 2024 or at any time thereafter, the opening and processing of Vote-By-Mail ballots will commence. This process will continue until all election results are tabulated and the election is certified. Any member of the County Grand Jury, and any other interested organization, shall be permitted to observe and challenge the manner in which the Vote-By-Mail ballots are handled, from the processing of ballot return envelopes through the opening, counting and disposition of the ballots.

NOTICE IS FURTHER GIVEN that the canvass will commence on March 7, 2024 at the Nevada County Elections Office.

NOTICE IS FURTHER GIVEN, in accordance with provisions of the Election Laws of the State of California, that on March 8, 2024 at 10:00 a.m., the Nevada County Elections Office will randomly select precincts for a manual tally of one percent of the precincts casting ballots at the March 5, 2024 Presidential Primary Election. This random selection of precincts will take place at the Nevada County Elections Office and is open to the public.

NOTICE IS FURTHER GIVEN that on or any time after March 18, 2024 at 10:30 a.m. the Nevada County Elections office will begin a manual tally of one percent of the precincts casting ballots at the March 5, 2024 Presidential Primary Election. This manual tally is open to the public and shall continue daily (Saturdays, Sundays and Holidays excluded unless otherwise decided by the County Registrar of Voters) until completed.
